A marketplace, not the gear owner.

1. What AYCR is

AYCR is a peer-to-peer marketplace that helps independent Owners offer eligible equipment, gear, and other rentable items to independent Renters. Unless AYCR expressly says otherwise, AYCR does not own, rent, manufacture, inspect, maintain, repair, insure, or control a listed item.

When an Owner accepts a booking, the Owner and Renter enter into a separate rental arrangement governed by these Terms, the listing, the booking details, applicable policies, and any disclosed item-specific rules. AYCR provides the technology that facilitates the transaction and is generally not a party to that rental arrangement.

2. Eligibility and accounts

You must be at least 18 years old and legally able to enter a binding contract to create an account, list an item, or complete a rental. You must provide accurate, current information and protect your account credentials.

• Do not impersonate another person, transfer an account without permission, or use an account for fraud or deception.
• You are responsible for activity conducted through your account and must promptly notify AYCR if you believe it has been compromised.
• AYCR may use third-party verification services. A verification, badge, review, or screening is not a guarantee or endorsement of a user's identity, reliability, skill, or safety.

3. Owner responsibilities

By listing an item, an Owner represents that the Owner owns it or has legal authority to rent it, the listing is accurate, and the item may lawfully be rented. Owners are responsible for maintaining their items and complying with applicable laws, contracts, insurance obligations, maintenance requirements, warnings, licensing, and permitting requirements.

• Accurately describe condition, capabilities, limitations, price, availability, and known defects.
• Use photographs that accurately depict the offered item.
• Do not list an item known to be unsafe, unlawfully rentable, subject to an unresolved safety recall, or prohibited by AYCR policy.
• Provide applicable operating instructions, warnings, safety equipment, and qualification requirements.

4. Renter responsibilities

Renters must review the listing and item rules before booking, use the item only for its intended and lawful purpose, follow manufacturer and Owner instructions, and exercise reasonable care while the item is in their possession.

• Have any required age, license, permit, certification, training, experience, or safety equipment before using an item.
• Inspect the item at pickup and do not use it if it appears unsafe, materially different from the listing, or unsuitable for the planned activity.
• Do not permit unauthorized use and return the item at the agreed time and place in substantially the condition received, ordinary wear and tear excepted.
• Promptly report an accident, injury, theft, loss, malfunction, or significant damage.

5. Bookings, pricing, and payments

A booking is governed by the dates, price, fees, cancellation terms, Owner rules, and other details presented through AYCR. Owners set their listed rental prices unless AYCR states otherwise. Applicable platform or payment fees will be disclosed before payment.

Payments and payouts are processed through Stripe or another provider identified in the booking flow. AYCR may facilitate collection, refunds, adjustments, and eligible payouts, less disclosed fees and amounts permitted by these Terms or applicable policy. Never arrange a booking payment outside AYCR to avoid platform protections or fees.

6. Pickup, return, damage, and cancellations

Owners and Renters are responsible for agreeing on pickup, delivery, and return arrangements through AYCR. Both parties are encouraged to document the item at handoff and return. The Cancellation and Refund Policy and Damage, Loss, and Claims Policy are incorporated into these Terms.

Renters may be responsible for documented damage, loss, or theft occurring during the rental period to the extent permitted by law and the applicable policies. Ordinary wear and tear is not renter-caused damage. AYCR may help collect information and facilitate resolution, but AYCR is not an insurer and does not guarantee any claim outcome.

7. Safety, insurance, and risk

Equipment use, outdoor recreation, travel, and similar activities can involve property damage, equipment failure, weather, falls, collisions, drowning, bodily injury, illness, disability, or death. Each user is responsible for evaluating the risks of a particular item or activity and, to the fullest extent permitted by law, voluntarily assumes risks associated with that user's rental transaction and use or provision of an item.

AYCR does not provide insurance unless an actual coverage or protection product is expressly identified in writing for a particular transaction. Personal insurance policies may exclude peer-to-peer rental activity. Users are responsible for deciding whether they have appropriate coverage.

8. Prohibited items and conduct

Users may not list prohibited or restricted equipment or use AYCR for unlawful, fraudulent, deceptive, abusive, or unsafe conduct. AYCR may remove a listing or suspend an account when it reasonably believes there is a safety, legal, fraud, payment, or marketplace risk.

• Do not list stolen property, false listings, illegal items, unsafe items, or items you are not authorized to rent.
• Do not manipulate prices, reviews, bookings, or transactions; threaten, harass, or discriminate against another user; or use another person's payment method without authorization.
• Do not bypass AYCR to complete a transaction introduced through the platform, introduce malicious software, scrape without authorization, or attempt unauthorized access.

9. Reviews and user content

Users may submit reviews, photos, descriptions, and other content. You retain ownership of your content, but grant AYCR a nonexclusive, worldwide, royalty-free license to host, reproduce, format, display, and distribute it as reasonably needed to operate, promote, and improve the marketplace, subject to applicable law and the Privacy Policy.

Do not submit content that is knowingly false, fraudulent, defamatory, threatening, discriminatory, unlawful, unrelated to the transaction, or unlawfully reveals another person's private information.

10. No guarantee; disclaimers

AYCR does not guarantee the condition, safety, legality, availability, suitability, or accuracy of a listing; the identity, conduct, skill, or reliability of a user; or that a rental will occur as planned. Any verification or screening is limited to the process described and is not a guarantee.

To the fullest extent permitted by law, the platform is provided AS IS and AS AVAILABLE. AYCR disclaims warranties of merchantability, fitness for a particular purpose, and non-infringement to the extent they may lawfully be disclaimed. Nothing in these Terms removes consumer rights that cannot legally be waived.

11. Limitation of liability, release, and indemnity

To the fullest extent permitted by law, AYCR and its affiliates, officers, directors, employees, and agents are not liable for indirect, incidental, special, exemplary, consequential, or punitive damages arising from a transaction between users, a third-party item, the conduct of another user, or the use of the platform. This does not limit liability that cannot legally be limited.

To the fullest extent permitted by law, users release AYCR from claims arising solely from disputes between users or third-party items or services, except for claims based directly on AYCR's own conduct that cannot lawfully be released. You agree to defend, indemnify, and hold AYCR harmless from third-party claims arising from your violation of these Terms or law, your item, your use of an item, your content, or your negligent, reckless, or intentional conduct, except to the extent prohibited by law.

12. Suspension, changes, and general terms

AYCR may restrict, suspend, or terminate access when it reasonably believes a user has materially violated these Terms, presents a fraud, safety, or legal risk, misused the platform, or repeatedly fails to complete transactions. We may update these Terms and will provide notice when required by law. Continued use after an effective update constitutes acceptance to the extent permitted by law.

These Terms and incorporated policies form the agreement governing AYCR use. If a provision is unenforceable, the remaining provisions remain effective to the extent permitted by law. Dispute-resolution, governing-law, and venue provisions will be finalized with AYCR's attorney before launch.
